House Judiciary Democrats back The New York Times against OpenAI, saying the Justice Department overstepped in its fair use filing

The House Judiciary Committee’s top Democrats filed a brief backing The New York Times and fellow news publishers in their copyright suit against OpenAI and Microsoft, saying the Justice Department overstepped its authority when it sided with OpenAI. In September, the department told the court that training AI on articles transforms them enough to count as fair use, and that AI’s value to national security outweighs the harm to publishers. Representatives Jamie Raskin, Jerrold Nadler, and Hank Johnson countered that the 1976 copyright law has no national security exception and doesn’t let the department invent one, calling its argument “a bulldozer” for copyright. Judge Sidney Stein is weighing motions for summary judgment that could decide the case without a trial.
