Temu hit with California class action accusing the marketplace of “spam abuse” through deceptive email tactics

Temu was hit with a class action lawsuit filed Monday in Los Angeles County Superior Court accusing the company of using false subject lines, misleading header information, and spoofed domains to push California shoppers into opening commercial emails. Plaintiff Dallas Pottish alleges Temu installed a “web of illegal tracking pixels” on consumer devices and used artificial urgency tactics like a “$0.01 False Nails” promotion that did not actually exist at that price, with the suit citing California Business and Professions Code Section 17529.5, which allows recipients to recover $1,000 per violation. The complaint estimates Temu is responsible for more than 10,000 spam emails to Californians each year, creating significant potential liability, and adds to a growing list of legal challenges targeting the company's marketing tactics including prior suits over unsolicited text messages.
