OpenAI faces class action lawsuit over AI robo calls and texts

by | Jan 1, 2026 | Latest E-commerce News & Updates

OpenAI is facing a class action lawsuit filed by a Virginia consumer alleging the company bears liability for illegal robocalls/texts generated through its platform. The complaint argued that the AI giant and Twilio, a communications API provider, facilitated violations of the Telephone Consumer Protection Act by enabling third-party Fresh Start Group to send non-consensual marketing messages. The suit sought to represent all U.S. recipients of unauthorized AI-generated outreach and claimed the companies knew or should have known their tools were being used for harassment.
