Plaintiffs claim OpenAI stonewalled rather than produce training datasets and ChatGPT logs, and that a recent employee deposition contradicts the company’s earlier statements about its ability to search those logs. OpenAI called the allegations false and said its limits on sharing ChatGPT logs protect user privacy, and that it will keep defending fair use while arguing the Times’s case is weakening. New York Times filed the case in late 2023, later joined by the Chicago Tribune and Ziff Davis, while rival Anthropic recently agreed to pay authors $1.5B over training Claude on pirated books.
