Temu is facing a California class action alleging it sent spam emails that used forged headers, spoofed sender domains, and misleading subject lines to lure consumers to its site, where it planted tracking pixels without consent, according to Top Class Actions. Dallas Pottish brought the case in California federal court against Whaleco Inc., Temu’s corporate entity, claiming violations of the state’s anti-spam and Trap and Trace laws. One email carried the subject line “$0.01 False Nails – Ends Soon” for a product Pottish says did not exist at that price, and he alleges the site’s pixels then tracked his activity for targeted ads. Pottish seeks $1,000 per spam email plus punitive damages and an injunction, while a separate New York case against Temu was pushed into arbitration.
