OpenAI can’t see the terms of the settlement that got Apple dismissed from Elon Musk’s antitrust suit, after Judge Pittman reviewed the agreement and denied OpenAI’s motion to compel its production. Pittman wrote that courts hesitate to force disclosure of confidential settlements because keeping them private serves the “strong federal policy” of encouraging parties to settle, and he found nothing in this one relevant to the claims still pending against OpenAI. Musk’s SpaceXAI, formerly xAI, sued Apple and OpenAI over claims the App Store favored ChatGPT and buried Grok, and Apple exited through the settlement, leaving OpenAI as the sole remaining defendant. Pittman did give OpenAI more time to file for summary judgment.
