OpenAI has asked a federal judge in the Southern District of California to dismiss a proposed class action from ChatGPT user Amargo Couture, arguing she consented to the alleged disclosures by accepting its privacy policy when she created an account and entered prompts, according to MediaPost. Couture sued in May, claiming queries about her health, finances, and other private matters were passed to Meta and Google through the Meta Pixel and Google analytics code embedded in the ChatGPT site. Her complaint brings claims under federal and California wiretap laws and intrusion upon seclusion, a California claim reserved for highly offensive privacy violations. OpenAI's motion points to policy language telling users their prompts go to vendors and service providers, and the company wants an October 5 hearing.
