Amazon must face a class action from eBay and Walmart shoppers who say its Buy Box rules kept prices high on rival marketplaces

Amazon must face a class action from US shoppers on eBay and Walmart Marketplace who say its seller rules inflated the prices they paid on those sites, after a federal judge certified the class in an order made public on November 2. The buyers argue that even after Amazon dropped an explicit price parity clause from its seller agreement in 2019, it kept enforcing one by pulling Buy Box eligibility from sellers whose products were cheaper elsewhere, so sellers kept prices up on rival marketplaces even when lower fees there would have let them charge less. Amazon says its price check only compares offers against a small group of large retailers and that sellers can win back the Buy Box by cutting their Amazon price, and it’s asking the Ninth Circuit to let it appeal.
