Amazon blocked from challenging NLRB structure in 9th Circuit

Amazon failed to block NLRB proceedings after the 9th Circuit Court of Appeals ruled that the Norris-LaGuardia Act prevents federal courts from intervening in active labor disputes. The unanimous panel rejected the company’s constitutional challenge regarding its “joint employer” liability for drivers at contractor Battle Tested Strategies. The decision conflicts with a recent 5th Circuit ruling favoring SpaceX, deepening a legal divide that increases the likelihood of Supreme Court intervention regarding the agency’s structural authority.
