Meta will ask the Supreme Court to review Washington’s political ad disclosure law after a nearly $25M state court loss

Meta will ask the Supreme Court to overturn a Washington ruling upholding the state’s political ad disclosure law, and Justice Elena Kagan gave it until November 15 to file. Washington’s Fair Campaign Practices Act makes any company running digital ads turn over an ad’s cost, sponsors, targeted locations and audiences, and impression count to anyone who asks. Then-attorney general Bob Ferguson sued Meta in 2020, and a King County judge found 822 violations in 2022, fining Meta $30,000 each for nearly $25M plus $10.5M to the state. Meta calls the law a First Amendment burden that pushed it and Google to stop selling political ads in Washington. Justice G. Helen Whitener wrote for the state majority that the law “may impact Meta’s motivation to host political speech” without preventing it.
