Reddit’s DMCA case against SerpApi and Perplexity survives dismissal weeks after a judge threw out Google’s nearly identical suit

Reddit’s DMCA suit against SerpApi and Perplexity survived a motion to dismiss on Friday, with U.S. District Judge Paul Engelmayer finding it plausible that SerpApi sold a tool for defeating Google’s access controls and Perplexity paid to use it. A different judge tossed Google’s nearly identical claim less than two weeks earlier, but Engelmayer said Reddit’s licensing deal with Google names specific prohibited uses, where Google had only asserted it holds licenses in general. Reddit’s argument turns on a contract term requiring partners to delete flagged posts when users remove them, which it says covers millions of posts a month.
