Apple told the judge in its trade secrets suit against OpenAI that OpenAI’s request to strike new Apple evidence was itself an improper attempt to “relitigate the merits” of Apple’s preliminary injunction motion. OpenAI had said Apple slipped new expert testimony into a reply brief to rebut OpenAI’s argument that Apple never adequately protected the secrets it says were stolen. Apple’s filing counters that objections to new evidence aren’t allowed to carry fresh argument and are limited to five pages, while OpenAI’s ran nine.
