Meta appeals Ofcom decision placing WhatsApp and Instagram in an Online Safety Act category carrying extra transparency duties

Meta is appealing Ofcom’s decision to put WhatsApp and Instagram in a category that saddles them with extra duties under the Online Safety Act, according to Ben Quinn at the Guardian. The category requires more disclosure, stronger controls for users, safeguards against fraudulent ads, and fuller record-keeping on illegal content. Meta’s lawyers filed the appeal last week, its second action against the regulator this year after a May challenge arguing Ofcom shouldn’t calculate its fees from worldwide revenue. TikTok and X are suing separately over how much data they have to hand Ofcom. Meta said the industry is challenging how Ofcom has read the law rather than “the law itself.”
