Shein gave no detail on what the agency is examining, but said it's cooperating and may reach a settlement, while warning that any outcome could require significant payments and materially hurt its financial condition. Both the FTC and Shein declined to comment. CNBC points to the agency's focus on dark patterns, which it defines as tactics like buried disclosures, pre-checked boxes, and cancellation flows built to confuse, noting Shein's app runs flash sales, countdown timers, and gamified discounts. Hong Kong cleared the listing recently after Shein's failed attempts in New York and London, with no trading date set.
