Google faces a bid to certify nationwide and state classes in a privacy suit alleging Google Analytics code on TaxAct and TaxSlayer collected consumers' tax return information without consent. Plaintiffs claim the collection violated the federal Wiretap Act, the California Invasion of Privacy Act, and the Florida Security of Communications Act, and they want subclasses in both states. The proposed nationwide class would cover anyone who finished a federal return on TaxAct since January 10, 2018 or on TaxSlayer since February 1, 2013. Mary L. Smith brought the original suit in July 2023 over H&R Block's site sending her tax data to Google, and later cases were consolidated with it. Google denies the allegations and says it supplies analytics tools rather than intercepting anything, though a judge refused to dismiss in June 2024.
